BETTER THAN THE BANK – TERMS AND CONDITIONS

These Terms and Conditions ("Terms") govern your access to and use of the website located at https://betterthanthebank.ca and the related client portal at https://app.betterthanthebank.ca (together, the "Website"), and any loan products, services, content, and tools made available through them (collectively, the "Services"), operated by Better Than The Bank ("Better Than The Bank," "we," "us," or "our").

By accessing or using the Website, submitting a loan application, or otherwise using the Services, you agree to be bound by these Terms and by our Privacy Policy, which is incorporated by reference. If you do not agree, please do not use the Website or the Services.


1. ABOUT US AND LICENSING

Better Than The Bank is a licensed Canadian broker that arranges and facilitates small-dollar consumer loans for residents of Ontario and British Columbia.

As a broker, we may arrange loans that are funded by us or by one or more third-party lenders. The identity of the lender and the specific terms applicable to your loan will be disclosed to you in your loan agreement before you accept it.


2. ELIGIBILITY

To apply for a loan or use the Services, you must:

(a) be at least the age of majority in your province of residence (18 in Ontario and 19 in British Columbia);
(b) be a resident of a province in which we operate (currently Ontario and British Columbia);
(c) have a valid Canadian bank account, a verifiable source of income, and a valid email address and phone number; and
(d) provide true, accurate, and complete information.

We may decline any application, in whole or in part, at our sole discretion. Approval is never guaranteed and is subject to our assessment criteria.


3. LOAN PRODUCTS AND COST OF BORROWING

We arrange short-term, payday, and installment loans ranging from $100 to $1,000.

- Minimum repayment period: 90 days.
- Maximum repayment period: 180 days.
- Annual Percentage Rate (APR): 31.98%.

Representative example: For a $300 loan over 90 days, the total payback before administrative fees is $316.00.

The full cost of borrowing, the total amount payable, the payment schedule, any administrative or default fees, and all other material terms applicable to your specific loan will be set out in your individual loan agreement. In the event of any conflict between these Terms and your signed loan agreement, the loan agreement governs your loan. Borrowing money has a cost; please borrow only what you can afford to repay.


4. APPLICATION PROCESS, CREDIT CHECKS, AND VERIFICATION

When you apply, you authorize us and our service providers to collect, verify, and use information about you to assess your application. This may include:

(a) verifying your identity, income, employment, and banking information, including through secure third-party bank-connection and income-verification services (for example, Flinks);
(b) obtaining credit information and reports from consumer credit reporting agencies and other sources, and reporting your loan and repayment activity to such agencies; and
(c) confirming the information you have provided through other lawful means.

By submitting an application, you consent to these inquiries. Details of how we handle your personal information are described in our Privacy Policy.


5. ELECTRONIC COMMUNICATIONS AND SIGNATURES

By using the Services, you consent to receive communications from us electronically, including by email, text message, and through the client portal, and you agree that electronic agreements, notices, disclosures, and other communications satisfy any legal requirement that such communications be in writing. You agree that electronic signatures, acceptances, and records are valid and binding to the fullest extent permitted by law. You may withdraw consent to electronic communications as described in our communications, subject to any legal requirement that certain documents be delivered electronically through the portal.


6. YOUR ACCOUNT AND CLIENT PORTAL

You are responsible for maintaining the confidentiality of your client portal login credentials and for all activity that occurs under your account. Notify us immediately at [email protected] if you suspect any unauthorized use of your account. We are not liable for any loss arising from your failure to safeguard your credentials.


7. REPAYMENT, PAYMENTS, AND DEFAULT

You authorize us and our payment service providers (for example, Zumrails) to disburse loan funds to you (including by Interac e-Transfer) and to collect scheduled repayments from your designated bank account by electronic funds transfer (EFT) or other agreed methods, in accordance with your loan agreement.

If a payment is missed, returned, or declined, you may be charged administrative or default fees as disclosed in your loan agreement and as permitted by applicable law. You remain responsible for repaying the full amount owing. We may report missed or defaulted payments to credit reporting agencies and may pursue collection of amounts owing as permitted by law.


8. THIRD-PARTY SERVICES AND LINKS

The Services rely on third-party providers (including bank-connection, identity and income verification, payment processing, and analytics providers) and may contain links to third-party websites. We do not control and are not responsible for the content, products, services, or privacy practices of third parties. Your use of any third-party service may be subject to that party's own terms and privacy policy.


9. ACCEPTABLE USE

You agree not to:

(a) use the Services for any unlawful, fraudulent, or unauthorized purpose;
(b) provide false, misleading, or another person's information;
(c) attempt to gain unauthorized access to the Website, the client portal, or any related systems;
(d) interfere with or disrupt the integrity or performance of the Services; or
(e) copy, reproduce, scrape, or exploit any part of the Services except as expressly permitted.


10. INTELLECTUAL PROPERTY

All content on the Website, including text, graphics, logos, the "Better Than The Bank" name and brand, images, and software, is owned by or licensed to Better Than The Bank and is protected by Canadian and international intellectual property laws. You may not use, reproduce, or distribute any such content without our prior written permission, except for your own personal, non-commercial use of the Services.


11. DISCLAIMERS

The Website and Services are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Website will be uninterrupted, error-free, or secure, or that any defects will be corrected. Nothing on the Website constitutes financial, legal, or tax advice.


12. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, Better Than The Bank and its directors, officers, employees, agents, and service providers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or relating to your use of (or inability to use) the Website or Services. Nothing in these Terms limits or excludes any liability that cannot be limited or excluded under applicable law, including under consumer protection legislation.


13. INDEMNIFICATION

You agree to indemnify and hold harmless Better Than The Bank and its directors, officers, employees, agents, and service providers from any claims, losses, liabilities, damages, costs, and expenses (including reasonable legal fees) arising out of or related to your breach of these Terms, your misuse of the Services, or your violation of any law or the rights of any third party.


14. PRIVACY

Your use of the Services is also governed by our Privacy Policy, which explains how we collect, use, disclose, and protect your personal information. Please review it carefully.


15. CHANGES TO THESE TERMS

We may update these Terms from time to time. Changes are effective when the updated Terms are posted to the Website with a revised "Last updated" date. Your continued use of the Services after changes are posted constitutes your acceptance of the updated Terms. We encourage you to review these Terms periodically.


16. GOVERNING LAW

These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law principles. You agree to the exclusive jurisdiction of the courts located in Ontario for any dispute arising out of or relating to these Terms or the Services, subject to any rights you may have under the consumer protection laws of your province of residence.


17. SEVERABILITY AND ENTIRE AGREEMENT

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect. These Terms, together with your loan agreement and our Privacy Policy, constitute the entire agreement between you and Better Than The Bank regarding the Services.
